Lawyers Call Man's Encounter With Deputy "Abuse Of Police Power" | News
Title (Max 100 Charaters)
ALEXANDRIA, Va. (WUSA)-- Alexandria lawyer Victor Glasberg says a Loudoun County Sheriff's deputy Terry Daniel was out of line when he blind sided his client Carlos Garcia and knocked him to the ground.
The event took place in November of 2011, and it was all caught on the deputy's patrol unit dashboard camera. In the video, you can see Garcia standing in front of an officer with his hands in the air. Deputy Daniel is then seen running into frame and behind Garcia. Once he gets to Garcia, he knocks him to the ground before handcuffing him.
Garcia, his friends, and some of his relatives were trying to get into a cab after a night of drinking at a bar in Sterling right before the events took place.
Glasberg said, "He has traumatic brain injury, intermittent memory loss, and intermittent migraines," as a result of the hit.
Garcia's defense team maintains that he was not a threat. They say there were at least two other deputies on scene and a police K-9 before Deputy Daniel even entered the situation. The video which was posted on YouTube shows Deputy Daniel was not the first deputy on scene and Garcia was not fighting with one.
Bernadette Armand, who is also representing Garcia said, "We do know that what happened that night did not justify his use of violence with Mr. Garcia."
9News Now reached out to the Loudoun County Sheriff's office for comment but they did not return phone calls on Tuesday night. According to Garcia's lawyers, Deputy Daniel is no longer employed by the sheriff's office, and has moved to another state.
